Oliyanov: Three European Countries Lack Legal Right to Trigger Snapback

Russia’s Permanent Representative to International Organizations in vienna stated: the European troika does⁢ not have​ the legal or ‍procedural right to activate snapback.

According ⁢to the ⁣English section of⁢ webangah News Agency, citing Mehr News Agency,‌ Mikhail Ulyanov,‌ Russia’s permanent representative to international organizations in Vienna, announced on the social media platform X that the United Kingdom, France, ⁢adn ​Germany have threatened to ​trigger ⁣the snapback mechanism to reinstate previous‍ sanctions against Iran.

The‌ Russian ⁤representative continued by⁢ urging a temporary suspension of‌ legal ⁤and procedural considerations- which clearly do not grant these three European countries ‌the right to proceed-⁢ and suggested analyzing the matter purely from a political ⁢perspective.

Ulyanov ​added that it raises the question of whether these ⁢three European nations have an exit⁤ strategy or any ​plan for⁢ resolving what‌ they intend as ⁤a deadlock. He indicated that the answer ‍appears negative.

Earlier,he stated⁣ that Britain,Germany,and France are attempting to pressure Iran by ⁣threatening to activate‍ the so-called ​”snapback” mechanism​ outlined in United Nations Security Council Resolution 2231‌ before‌ August ends. However, ther is ‌a significant obstacle preventing this⁢ threat’s‍ implementation.⁤ The trio-which represents Europe’s side in the 2015 Iran nuclear⁣ deal-is itself violating Resolution 2231 and‌ the Joint Extensive Plan of ​Action (JCPOA). Therefore, legally speaking, as violators they lack authority‍ to initiate snapback.

The doctrine of good faith in international ⁣law prohibits any party from claiming rights under an agreement⁣ while simultaneously neglecting its obligations under that same agreement. (Referencing the​ International court of Justice ⁢advisory opinion​ on ‍legal consequences for states regarding South Africa’s ​continued presence in Namibia despite UNSC resolution 276 [1970]). Simply put, attempts by these three‍ European countries (the UK, Germany, and France) to trigger snapback despite ‍their own​ noncompliance with UNSC Resolution 2231 fundamentally contradict core‌ principles of international law.
